TravelServe Limited Terms and Conditions

These terms and conditions and airlines and hotel based booking form constitute the entire Agreement concerning the provision of a private hire and airport transfer service (“Service”) between the passenger, driver and TravelServe Limited. TravelServe complies with the TFL Regulation 9(14) and acts solely as the principal for the Service and the contract with the passenger is directly with TravelServe and not with the driver.

Completion of the booking form and use of the Service indicates the passenger’s unconditional acceptance of the terms and conditions set out in this Agreement.

1. Booking

2.1 Passenger must allow sufficient time when booking the private hire vehicle to allow for the check-in times required by the airline and for any delays caused by traffic conditions. TravelServe shall not be responsible for any delay caused by passenger failure to allow enough time to reach the destination or if passengers are not ready for collection at the booked time.

2.2 Passengers must order a suitable car size for the number of passengers and luggage. TravelServe cannot guarantee to carry excessive amounts of luggage. A child of any age counts as 1 passenger.

2.3 If a passenger needs to transport a wheelchair this must be specified at the time of booking.

3. Prices and Payment

3.1 TravelServe will inform passengers of a quotation based on the information supplied. Unless otherwise stated all prices are exclusive of VAT which, if applicable, will be charged in addition. TravelServe may amend the quotation if there is any material change to the original itinerary, number of passengers or the type or size of vehicle required.

3.2 The quotation includes a 45 minute waiting period after the advertised landing time and the cost of car parking if a meet and greet service has been selected. TravelServe will charge waiting time at standard rates after the initial 45 minute period. TravelServe may check for flight delays but is under no obligation to do so.

3.3 Upon acceptance of the quotation passengers will receive booking confirmation by email. Passengers must check confirmation details carefully. TravelServe is not responsible for delays or costs caused by incorrect information supplied by passengers.

3.4 All journeys originating at an airport must be prepaid in full at least 24 hours before the date of travel unless part of a return journey.

3.5 Payment may be made by credit card, debit card, cash or cheque with a valid guarantee card. Cheque payments must be made at least 7 days before travel.

4. The Service

4.1 Passengers are responsible for behaviour during the journey. A charge of £100 applies if the vehicle requires cleaning due to passenger actions.

4.2 Eating, drinking and smoking in vehicles are not permitted.

4.3 Children must be restrained appropriately for age, weight and height. Child seats should be supplied and fitted by parents where possible.

4.4 TravelServe will not carry more passengers than permitted by insurance or licensing.

5. Cancellations

Passengers should contact TravelServe as soon as possible to cancel. If cancellation occurs after vehicle dispatch charges may apply based on distance and time traveled. Airport journeys are typically dispatched up to 2 hours before flight arrival. Local Heathrow area journeys may be dispatched up to 20 minutes before pickup time.

Bookings cancelled through the Quote Book Pay service before dispatch incur a 5 percent charge on the original payment.

6. Liability

6.1 TravelServe will use reasonable efforts to deliver passengers on time but is not liable for delays caused by traffic or road conditions beyond its control. TravelServe is not liable for indirect or consequential loss including loss of profits or business.

6.2 All luggage is carried at the passenger’s risk.

6.3 TravelServe may cancel services and provide refunds in events such as national emergencies, extreme weather, fuel shortages or terrorist activity. In case of vehicle breakdown an alternative vehicle will be arranged where possible.

6.4 Passengers shall indemnify TravelServe against losses, damages, costs and expenses arising from passenger acts or omissions.

6.5 Nothing limits liability for death or personal injury caused by negligence, fraud or misrepresentation where unenforceable by law.

7. Termination

TravelServe may refuse or terminate bookings immediately if passenger behaviour risks damage, abuse or violence. No refunds are provided for terminated journeys.

8. Miscellaneous

8.1 TravelServe may subcontract journeys to another TFL licensed operator when necessary while retaining full responsibility.

8.2 TravelServe may update these terms by posting changes online. Existing bookings remain subject to rates at time of booking.

8.3 Personal data is processed in accordance with applicable data protection legislation.

8.4 This Agreement and any quotation represent the entire agreement between passenger and TravelServe.

8.5 No third party rights are created under the Contracts Rights of Third Parties Act 1999.

9. Disputes

This Agreement is governed by English law and subject to the exclusive jurisdiction of the English Courts.

10. Conveying of Children

UK law exempts private hire vehicles from child seat legislation. TravelServe does not provide child seats. Passengers may supply their own and are responsible for installation.
